These Terms & Conditions (“Terms”) govern your access to and use of PKTenders.com (the “Website”), operated by PKTenders (Pvt.) Ltd. (“PKTenders,” “we,” “us,” or “our”). By using the Website to view, download, or submit tenders, you agree to be bound by these Terms and by all applicable Pakistani laws and regulations, including but not limited to:
Public Procurement Regulatory Authority Ordinance, 2002 (“PPRA Ordinance, 2002”): the principal federal law establishing the Public Procurement Regulatory Authority and laying down procurement procedures, transparency requirements, and sanctions.
Public Procurement Rules, 2004 (“PPRA Rules, 2004”): rules issued under the PPRA Ordinance detailing method of procurement, eligibility criteria, evaluation, and complaint mechanisms.
Any provincial procurement acts and rules (e.g., Khyber Pakhtunkhwa Procurement of Goods, Works & Services Rules, 2014, etc.) where applicable.
“User” means any individual or entity accessing or using the Website.
“Tender” means a formal invitation by a procuring agency for bids to provide goods, services, or works.
“Procuring Agency” has the meaning given in the PPRA Ordinance, 2002 (i.e., any federal, provincial or local government body or statutory authority conducting procurement).
Eligibility: You represent and warrant that you are legally capable of entering into binding contracts under Pakistani law and that you have complied with any licensing, tax, or regulatory requirements to participate in public procurement.
Compliance with PPRA Law: All tenders hosted or accessed via the Website must strictly follow the PPRA Ordinance, 2002 and PPRA Rules, 2004. You agree to abide by:
The prescribed modes of procurement (e.g., open competitive bidding, limited bidding, single-source procurement, etc.) under Rule 11–16 of the PPRA Rules, 2004.
Advertisement and bidding period requirements (Rule 6 & 7).
Bid security, performance security, and evaluation criteria set out in PPRA Rules, 2004 (Rules 29–31).
Accurate Information: You shall provide complete, truthful, and up-to-date information when registering, submitting a tender response, or otherwise interacting with the Website.
Tender Documents: You acknowledge that tender documents available on PKTenders.com are provided by procuring agencies, and we do not guarantee their completeness or accuracy. Always refer to the original procuring agency’s notice.
Bid Submission: Submission deadlines, formats, and required deposits (earnest money/bid security) are governed by the PPRA Rules and the specific procuring agency’s terms. PKTenders is not responsible for missed deadlines or non-compliant submissions.
Website Content: All content, logos, trademarks, and software on PKTenders.com are the property of PKTenders or used with permission. You may view and download content solely for your personal or internal business use in connection with public procurement.
Prohibitions: You may not copy, modify, distribute, sell, or lease any portion of the Website without our prior written consent.
No Warranty: The Website, including all content and services, is provided “as is” and “as available,” without any warranty, express or implied, including warranties of accuracy, completeness, merchantability, or fitness for a particular purpose.
Limitation of Liability: To the maximum extent permitted by law, PKTenders (and its officers, directors, employees, agents) shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of or inability to use the Website, even if advised of the possibility of such damages.
Total Liability Cap: PKTenders’s total aggregate liability for any claim arising out of or relating to these Terms shall not exceed PKR 10,000.
You agree to indemnify and hold harmless PKTenders and its affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or rights of a third party, or your use of the Website.
PKTenders may suspend or terminate your access to the Website at any time, without prior notice or liability, if you breach these Terms or for any other reason in our sole discretion.
Governing Law: These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, including the PPRA Ordinance, 2002.
Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved by arbitration administered by the Islamabad Centre for Alternative Dispute Resolution (ICADR) in accordance with its rules. The seat of arbitration shall be Islamabad, Pakistan, and the language shall be English. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
We may revise these Terms at any time by publishing an updated version on PKTenders.com. The updated Terms shall become effective on the “Last updated” date stated above. Your continued use of the Website after such date constitutes acceptance of the revised Terms.
